ORDER ACCEPTANCE POLICY

Receipt of an electronic or other order confirmation does not signify our acceptance of your order nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or reject your order for any reason or to supply less than the quantity you ordered of any item.

CHANGE OF ADDRESS

There is no charge if you change an address before your order is shipped. However, due to increased costs by carriers, we will now charge $35 USD for any address change, including, but not limited to, redirections or address corrections to your order after it ships. We will not charge you if the change is the result of warehouse or carrier errors.

OUT OF STOCK PRODUCTS

We will ship your product when it is available. However, there may be times when the product you have ordered is out of stock, which will delay the fulfillment of your order. We will keep you informed of any product you have ordered that is out of stock and not available for immediate shipment. You may cancel your order at any time prior to shipment.

MULTIPLE PRODUCT ORDERS

For a multiple product order, we will make every effort to ship all products included in the order at the same time. Products that are not available at the time of shipment will be shipped as they become available, unless you inform us otherwise. You will only be charged for products included in a given shipment, plus applicable shipping charges. You will only be charged for shipping at the rate indicated on your sales receipt. The entirety of this shipping charge may apply to the first products shipped in a multiple shipment order.

PAYMENT - CREDIT CARDS

We accept the following credit cards: Visa and MasterCard. There is no surcharge for using your credit card to make purchases. Be sure to provide your accurate billing address and phone number (i.e., the address and phone number your credit card bank has on file for you). Incorrect information will cause a delay in processing your order. Your credit card will be billed at the time your order is shipped.

PAYMENT - PURCHASE ORDERS

We accept purchase orders for payment. We must approve your organization for credit terms and conditions. We have the right to refuse credit terms to organizations that do not meet or exceed our credit requirements. Standard terms for purchase orders are net 30 days. International customers may use wire transfers or credit cards to make purchases.

TAXES

Our store is set up to automatically collect and withhold sales tax for orders delivered to addresses within the same state as our locations. For orders shipped to other states, customers are solely responsible for reporting all sales or other taxes.

WARRANTIES

All products shipped are covered by their manufacturer's warranty or guarantee. Product warranty/guarantee details are usually found on the product packaging. If a product does not perform as warranted, contact the manufacturer.

TYPOGRAPHICAL AND COMPUTER ERRORS

We work hard to eliminate store errors and provide the most up-to-date product pricing and information. With thousands of products and SKU's, not everything will be 100% perfect. In the event that a product is listed at an incorrect price due to typographical error, computer error or pricing information received from our suppliers, we have the right to refuse or cancel any orders placed for product listed at the incorrect price. We have the right to refuse or cancel such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, we will immediately issue a credit to your credit card account in the amount of the incorrect price. If you believe the price is incorrect after placing an order, please send us your order number and contact information. We will use reasonable efforts to resolve any site errors. If we are unable to resolve the situation, we will request that you return the unused, undamaged product to us in the original packaging within 5 business days and we will provide you with a full refund.

PRICE SUBJECT TO CHANGE WITHOUT NOTICE

We work with many manufacturers and carry thousands of products. Manufacturers determine when to change prices. Sometimes we receive timely notice of price changes and sometimes we do not. Price updates are an ongoing process and products can be quoted at any time. We will always do our best to update product prices to ensure a reliable and quality experience from our company.

PRIVACY AND CONTENT ON OTHER WEBSITES

Other sites accessible through our site have their own privacy policies and data collection practices. Please refer to each site's privacy policy. We are not responsible for the actions of third parties.

This store may contain links to other sites on the Internet that are owned and operated by third parties. We have no control over third party sites and are not responsible for the operation of or content located on or through such sites.

Unless otherwise specified, all materials appearing on this site, including text, site design, logos, graphics, icons and images, as well as the selection, assembly and arrangement thereof, are the exclusive property of this Store. PRICES

All our products are quoted in US dollars.

RATES AND SETTLEMENT

With respect to product fees, the User will be charged the fees set forth in the applicable section as offered on the website. The Fees include the value added tax as provided by the applicable laws in the United Mexican States (16%).

In addition to the purchase price, Buyer shall be responsible for bearing all taxes incurred, including value added, excise, use, privilege, ad valorem, customs and any other similar taxes, levies, fees or charges, taxes imposed or increased by virtue of any law, rule, ordinance or regulation of any municipal, state, local, state, federal or local government, ordinance or regulation of any municipal, state, federal, international or any other nation with respect to the goods sold to the customer or any part, component or material contained therein, including the importation, processing, distribution, sale or export of raw materials, parts or manufactured goods. Buyer shall also be responsible for any additional expenses incurred by Seller as a result of obligations imposed by municipal, state, federal, international or any other nation's laws regulating labor fees and costs for the production of the goods. In the event that Seller, for any cause whatsoever, shall become obligated to pay such taxes, Buyer shall, upon request, immediately reimburse Seller for such amounts. Buyer shall provide, upon Seller's request, any tax exemption certificate.

In addition, to the extent required by applicable laws in each country, Users agree to send us duly completed tax forms to enable us to make all required filings with the tax authorities.

CHANGE OF FEES

We may change the Fees and/or introduce new charges in addition to the Fees at our sole discretion with thirty (30) days prior written notice to the User.

Notwithstanding the foregoing, we may increase the Fees, immediately and with contemporaneous notice.

LIMITACIONES A LA RESPONSABILIDAD

To the maximum extent permitted by applicable law, BEWELL MEDICAL shall not be liable, in any event, for any direct, special, incidental, indirect, or consequential damages that in any way arise out of or relate to:

You agree to indemnify BEWELL MEDICAL, its Resellers, suppliers, vendors and consultants from any action, suit or claim (including attorneys' fees and court costs) arising out of any breach by you of this agreement; including, without limitation, any arising out of:

SUBSISTENCE

These terms and conditions of use, as well as any additional terms, constitute the entire agreement between the parties, and supersede any prior agreements or understandings. Any clause or provision of this agreement, as well as the additional terms, legally declared invalid, shall be eliminated or modified at the option of BEWELL MEDICAL, in order to correct its defect or flaw. However, the rest of the clauses or provisions shall maintain their force, binding and validity.

NON-WAIVER OF RIGHTS

The inactivity on the part of BEWELL MEDICAL, its Resellers or suppliers to exercise any right or action derived from the present agreement, shall at no time be construed as a waiver of such rights or actions.

GOVERNING LAW AND JURISDICTION

This agreement shall be subject to and construed in accordance with the laws of Mexico. 

OTHER TERMS AND CONDITIONS

These Conditions shall supersede any terms and/or conditions you include with any purchase order and order notes, whether or not we sign them. We reserve the right to make changes to this site and these Conditions at any time.
